AN IRVINE man who had sex with his aunt has been slammed for committing an offence of 'biblical' proportions after narrowly avoiding a jail sentence.

Sheriff Seith Ireland told Stephen Green that his crime had caused public revulsion at Kilmarnock Sheriff Court last week.

Green, 25, of Woodlands Avenue, had pled guilty to a charge of having sex with his 52-year-old aunt at her house in February last year - reduced from a charge of rape.

His solicitor Jim Irvine told Kilmarnock Sheriff Court that the case was a particularly difficult one, but argued that background reports said Green was at a 'low risk of reoffending'.

He added that Green"s aunt Moira Compton was not required to testify in court because of his early admission of guilt.

Mr Irvine asked Sheriff Ireland to consider 'what would be gained if you jailed the accused'.

Sheriff Ireland admitted that his first thought had been a custodial sentence for the 25-year-old.

He told him: 'This has been an offence since the days of the bible thousands of years ago. The circumstances are inexplicable as to how they took place.

'When this first came before me custody was uppermost in my mind.'

However, he told Green that he was going to issue a probation order and community service as a direct alternative to prison, adding: 'If you commit a further offence then there will be no option but to issue a sentence which shows the public revulsion known to our ancestors in biblical times.'

Green was ordered to serve two years probation and 240 hours community service.

The Times was approached by a relative of Green"s following the sentencing and told he wished to contact us to give us a statement. However, despite attempts to get in contact with him there was no reply.
