A man arrested in connection with a flashing incident in a Kilwinning park, will not face prosecution, the Times can reveal.
Police arrested a 53-year-old man on September 8, four days after a woman reported that a man had approached her and exposed himself to her as she walked her dog in McGavin Park.
However the Times has since learned that the man has been released without charge due to “insufficient evidence”, according to the Procurator Fiscal’s office.
A Crown Office spokesman said: “After full and careful consideration of the facts and circumstances of the case, the Procurator Fiscal decided that there was insufficient evidence available for a prosecution and as a result no criminal proceedings are being taken at this time.
“The Crown reserves the right to proceed in the future should further evidence become available.”
