A MAN who watched his ex partner though her kitchen window in Ayr has been ordered to stay away from her. 

Dale Jeffrey, admitted phoning her and uttering remarks which indicated he was watching her, sending her messages via social media, phoning her family to make offensive comments and making offensive gestures towards her.

The incidents took place between November 2017 and February 2018 at three separate streets in Ayr. 

Jeffrey appeared from custody before Sheriff Carole Cunninghame at Ayr Sheriff Court last week. 

Depute Procurator Fiscal said: “On November 1 last year the woman was in the kitchen with her new partner when she received a phone call via Facebook message. She put the call on loudspeaker.

“Jeffrey said ‘I hope you are enjoying your cigarette’. The woman said [to her new partner] he must be watching us from the back garden’. She closed the blinds. 

“Jeffrey asked her ‘why have you closed the blinds’? On January 31, 2018 she received another message from the accused. On February 1, the woman’s brother, was at home when he received a Facebook message call from Jeffrey.

“He said ‘hi it’s Dale you’re a f*d and your f***ing sister is a dirty b**t. On the same date the complainer and her new partner were travelling to Ayr on the bus.

“They saw the accused standing at the bus stop. They decided to stay on board. They were approaching King Street and saw the accused passing on a bus using offensive hand gestures.

“The woman has asked for a Non Harassment Order.”

Speaking on his behalf, defence solicitor Ian Gillies, said: “Mr Jeffrey resides in Renfrew and he was in a relationship with this lady. His mother lives in Ayr. He accepts what he did was stupid.

“He knows he was a nuisance and annoyed the complainer. He doesn’t want to stop the non harassment order. He only comes to Ayr to visit his mother. There will be no repetition of this type of behaviour.”

Addressing the dock, Sheriff Carole Cunninghame, said: “Especially with your record you will be well aware that the court is considering a custodial sentence

“You are remanded because of your behaviour, but on balance the court is just persuaded to provide a direct alternative.”

Jeffrey, who is from Renfrew, has been placed on a community payback order and will be under supervision for 12 months. He will also complete 80 hours of unpaid work for three years.

He has also been placed on a non harassment order for 12 months and told not to approach, contact or communicate with his ex partner in any way through social media, including making any comments about or directed to her on social media.
