A carer who was so drunk that she neglected a disabled woman and allowed her to fall from her wheelchair onto a driveway has dodged a jail term.

Yvonne Clark ill-treated or wilfully neglected a disabled woman in her care at an address in Saltcoats on January 6 this year.

Clark, of Benbain Place in Irvine, had previously appeared at Kilmarnock Sheriff Court and pleaded guilty to two charges.

Sentence had been deferred for reports and the 55-year-old returned to court this week to hear her fate.

Clark was providing care or treatment or purporting to provide care or treatment to a patient who has learning difficulties and is disabled. Clark was so intoxicated that she failed to take proper care of the woman or herself.

She also permitted the patient to fall from her wheelchair onto a driveway, allowed her to sit on the driveway, repeatedly struck the woman’s wheelchair while she was sitting in it, failed to treat or obtain treatment for injuries to her, and failed to keep her clean and tidy Clark also behaved in a threatening or abusive manner in that she shouted and swore at police officers in the presence of the patient and placed the woman in a state of distress.

Clark was given a Community Payback Order with 12 months supervision and a Protection of Vulnerable Groups referral.

She was also given a Restriction of Liberty Order requiring her to remain within her home address between the hours of 7pm-7am for a period of three months.
