THE OWNER of a popular Irvine pub is furious after the council told him to take down his smoking shelter canopy - and said he will appeal their ruling with a government watchdog.
Stuart Brown, who runs the Porthead Tavern in High Street, said the order seemed to be based on the personal tastes of a planning officer and added: "The council planning department act think they are a law unto themselves."
Landlord Stuart, who took over the pub a year ago, has battled in recent months to keep the retractable awning which he put up at the front of his pub to protect smokers from the rain.
But now NAC planners have ruled that it has to be taken down, as it was put up without permission in a town centre conservation area.
Stuart said: "I think it's a personal thing from somebody in the council planning department."
