PROPERTY FACTORS (SCOTLAND) ACT 2011 PUBLIC NOTICE UNDER SECTION 9(3)

The Scottish Ministers hereby give public notice of
removal of the property factor named below from
the Property Factor Register under section 4(7) of
the Property Factors (Scotland) Act 2011:
Paris Steele WS, 35 Westgate, North Berwick EH39 4AG
The date of removal is 18th June 2019
This means the relevant date under section 9(2) of
the Property Factors (Scotland) Act 2011 (effect of
removal) is 19th June 2019. Accordingly, after
19th June 2019
? No costs incurred by the property factors in respect of work instructed after 19th June 2019 are recoverable;
? No charge imposed by the property factors which relates to a period after 19th June 2019 is recoverable;
? Homeowners may appoint new property factors (or decide to manage their properties without appointing a property factor) in accordance with the procedures made in relation to such decisions in their title deeds or, as the case may be, the Tenement Management Scheme; and
? The property factors may not lodge a notice of potential liability for costs under section 13(1) of the Tenements (Scotland) Act 2004 (asp 11) in respect of work instructed after 19th June 2019.
