A young man who exposed himself and chased a teenage girl dodged jail – after protests that he was just innocently urinating during the incident.

Remorseless Alan Murphy, 22, was told he had an issue with denial after the incident only minutes from his own house after he appeared for sentencing last week for intentionally exposing genitals for another person to see without their consent.

Court papers state Murphy, of Church Street, Kilwinning, intentionally engaged in the sexual activity in the presence of the 17-year-old victim in Shavian Terrace and Blacklands Avenue back in July 21, 2020.

The complaint states Murphy pursued the complainer and then repeatedly exposed his member and pleasured himself.

When Murphy, represented by Finlayson, appeared for sentencing at Kilmarnock Sheriff Court last week [Monday, July 12] his defence solicitor said he had nothing to add to the Criminal Justice Social Work Report but that his client continued to deny the allegations after being found guilty.

However, Sheriff Elizabeth McFarlane questioned why the offender would stop two minutes from his own home address to urinate.

Sheriff McFarlane said: “Mr Murphy when I was training, Sheriff said to me that if the accused does not accept responsibility he goes to prison”, however added that she “would step back from custody”.

Murphy was given a community payback order and placed unter the supervision of authorities for one year to deal with his issues, with Sheriff McFarlane adding “denial being one them”.

He will also have to register as a sex offender for the same period for the

offence.
